In Azerbaijan, alimony is not limited to cases where a marriage has been officially dissolved. Under national legislation, spouses may claim financial support even while the marriage legally continues, provided certain conditions are met.
According to family law, spouses are obligated to support each other and their children financially during marriage. If this obligation is not fulfilled, alimony may be claimed through legal procedures without filing for divorce.
When Alimony Can Be Claimed Without Divorce
Failure to support a child
If spouses live separately and one parent does not contribute financially to the child’s upbringing, the other parent has the right to seek child support without ending the marriage. This is the most common scenario.
Pregnancy and childcare up to age three
A woman has the right to claim alimony for her own maintenance during pregnancy and while caring for a child under the age of three. This right applies regardless of whether the marriage remains intact.
Incapacity to work
Alimony may also be granted to a spouse who:
has a disability,
is unable to work due to health conditions,
is in financial hardship and does not receive adequate support from the other spouse.
De facto separation
Even if a marriage is officially registered, alimony may be awarded if the family has effectively broken down and one spouse fails to provide financial support.
How Alimony Is Determined
Alimony can be established either:
by mutual agreement between the spouses, formalized through a нотариal contract, or
by court decision if no agreement is reached.
The amount is determined based on the financial situation of both parties, the number of children involved, and their actual needs.
Divorce is not a mandatory requirement for claiming alimony in Azerbaijan. The decisive factor is the failure to meet legally defined financial obligations. Current legislation is designed to protect the rights of both children and spouses in need, even when a marriage has not been formally dissolved.
