What’s New in Azerbaijan’s Labor Code: Paid Leave, Remote Work, and Travel Rules

Recent amendments to Azerbaijan’s Labor Code have come into force, introducing significant changes to how leave, business trips, and remote work are regulated. The new rules were approved by parliament at the end of 2025 and signed into law in January 2026, aiming to align national legislation with international labor standards and modern workplace realities.

Paid Paternity Leave Introduced

One of the most notable changes is the introduction of paid paternity leave. Fathers are now entitled to 14 calendar days of paid leave, which can be taken shortly before or after the birth of a child, upon submission of a medical certificate. Previously, this leave was unpaid.

Maternity Leave Calculation Updated

The rules for maternity leave have also been clarified. If childbirth occurs later than expected, the prenatal portion of leave is automatically extended so that mothers do not lose any part of their postnatal leave, which remains 56 days in standard cases and up to 70 days in complicated births or multiple deliveries.

New Status: Employees With Family Responsibilities

The amended code introduces the concept of an employee with family responsibilities-workers who care for children, elderly parents, spouses, or dependents. Employers are prohibited from discriminating against such employees in promotion decisions, work schedules, or night shifts, provided their requests are justified and operationally feasible.

Expanded Eligibility for 46-Day Annual Leave

The list of workers entitled to 46 calendar days of annual leave has been expanded. It now includes war veterans, individuals with disabilities resulting from military service, participants in combat operations, and those involved in the aftermath of the Chernobyl disaster.

Remote Work and Business Trips Clarified

For the first time, the Labor Code formally defines remote work and electronic business trips. Employees working remotely retain the same rights to pay, leave, and social protections as on-site staff. Conditions related to equipment, internet access, and logistics are to be agreed upon in employment contracts.

Vacation Pay Timing

While vacation pay is generally required to be paid no later than three days before leave begins, the new rules allow alternative payment timelines by mutual agreement, provided this is clearly stated in individual or collective labor agreements.

Teachers’ Leave Rules Adjusted

For educators, the law clarifies that annual leave is typically taken during the summer break. However, with employer consent, part of the leave may now be used during the academic year, offering greater flexibility.

Night Work Compensation

Employees working night shifts are entitled to an additional payment of at least 20% of their hourly wage for each hour worked at night.

What This Means

Legal experts say the amendments are designed to reduce workplace disputes, improve work-life balance, and provide clearer protections for both employees and employers. While many issues-such as short-term leave or flexible schedules-remain subject to mutual agreement, the updated code establishes firmer legal ground and greater transparency in labor relations across Azerbaijan.
