Azerbaijan Plans 14-Day Paid Paternity Leave in New Labor Reforms

Azerbaijan is preparing a new package of amendments to its Labor Code to bring national regulations closer to International Labour Organization (ILO) conventions.

As Report writes, the draft amendments were discussed at Wednesday’s meeting of the Milli Majlis Committee on Regional Affairs.

According to lawmakers, several concepts required under ILO conventions ratified by Azerbaijan have now been formally incorporated into the legislation, including the terms “worker with family responsibilities” and “minimum wage.”

One of the key proposals concerns Article 94 of the Labor Code. In line with ILO Recommendation No. 165, employers would be obliged to take measures to provide full-time employment to part-time workers once a relevant vacancy appears or when the circumstances that originally required part-time work no longer apply.

A new section inspired by the ILO Convention on Maternity Protection would also be added to the Code. Under the proposal, the prenatal portion of maternity leave – with full salary—would be extended to cover the number of days between the start of pregnancy and the date of childbirth. Importantly, the postnatal portion of leave would not be reduced.

The amendments also introduce stronger guarantees for fathers. Men would be entitled to a paid 14-day leave – covering both the prenatal and postnatal period – based on a medical certificate issued after the birth of a child.
