Azerbaijan: Outcry Over Alleged Sexual Abuse of 4-Year-Old, Punishment Discussed

Sabirabad, Azerbaijan – Public outrage and concern have erupted following reports of a 64-year-old man allegedly committing acts of sexual violence against a 4-year-old girl in the Sabirabad district. The incident has sparked extensive discussion on social media, raising questions about the potential punishment the accused faces.

Commenting on the situation for Bizim.Media, lawyer Vusal Jafarov emphasized that criminal prosecution in such cases does not depend on a complaint being filed by the victim’s parents. Crimes against minors are considered socially dangerous, and the state is obligated to protect the rights of the underage. “Investigative bodies are required to investigate such cases regardless. Reconciliation does not exempt one from criminal liability,” the lawyer noted.

According to Jafarov, criminal liability could fall under the following articles of the Criminal Code of the Republic of Azerbaijan:
  • Article 152: This article stipulates imprisonment from 4 to 8 years for sexual acts involving violence, the threat of violence, or exploiting the helpless state of the victim, if the victim has not reached the age of 14.
  • Article 153.2: This article provides for imprisonment from 2 to 5 years for indecent acts committed against a person under the age of 14.
Even if the parents do not file a complaint, this will not prevent the initiation of a criminal case. Such crimes are viewed by the state as a threat to society as a whole; therefore, an investigation is launched irrespective of the victim’s position.
Currently, the Sabirabad District Prosecutor’s Office is conducting an investigation into the incident. The legal classification of the accused’s actions and the determined measure of punishment will be established upon its conclusion.
