BAKU, July 24 — Mistaken bank transfers—often caused by a mistyped account number—are a common headache for cardholders in Azerbaijan. But what does the law say when money lands in the wrong account?
According to Iqtisadiyyat.az, Azerbaijan’s legislation provides a clear procedure for such cases.
First, the person who made the error should immediately contact their bank. The bank will then reach out to the unintended recipient in an effort to resolve the situation amicably. However, a refund is only possible if the recipient agrees to return the funds voluntarily.
If the recipient refuses, the sender has the right to take legal action through a civil court.
Under Article 194 of the Civil Code of the Republic of Azerbaijan, unjust enrichment is considered illegal, and the wrongfully received funds must be returned.
Legal experts urge the public to double-check the recipient’s card number and full name before confirming any transfer. Carefully reviewing payment details before hitting “send” can help prevent a costly mistake.
