Baku Moves to Formalize Work-From-Home Rules in Sweeping Labor Code Update

Azerbaijan is preparing to formally recognize remote work within its national labor legislation, marking a significant shift in how employment relations are regulated in the country.

According to proposals discussed at today’s meeting of the Milli Majlis Committee on Regional Affairs, the term “remote (distant) work” will be added to Article 3 of the Labor Code. Lawmakers say the goal is to establish a clear legal framework for employees whose job duties can be carried out away from the employer’s premises.

The draft emphasizes that remote work should be considered a priority direction for modernizing the labor market, especially as digital tools make it increasingly feasible. By defining remote work in law, the amendments aim to ensure that employees performing their duties from home or other suitable locations enjoy the same legal protections as those working on-site.

Under the proposal, remote work is described as the performance of job functions using electronic, software-technical, telecommunication or similar tools, at locations outside the workplace created by the employer – including the employee’s home or any other place suitable for work.

The updated article also clarifies that the Labor Code fully applies to employees who work from home or in any remote format while using the employer’s materials, equipment, or production resources.

If adopted in the upcoming readings, the amendments will effectively formalize remote employment in Azerbaijan – a shift that aligns the country’s labor legislation with global post-pandemic trends and growing demand for flexible work arrangements.
