Azerbaijan: Travel Ban Possible for Loan Guarantors, Experts Say

The issue of guarantors in loan agreements has become one of the most debated legal topics in Azerbaijan, with many asking whether a travel ban can be imposed not only on borrowers but also on guarantors.

Cybersecurity and legal expert Elvin Abbasov explained to Patrulaz.az that under Azerbaijani law, a guarantor carries the same responsibility as the borrower.

“The mechanism of suretyship is enshrined in the Civil Code. If the borrower fails to meet credit obligations, the creditor may demand repayment from the guarantor. Thus, the guarantor shares liability with the debtor,” Abbasov said.

He stressed that a travel ban is possible only by court decision. If a loan is unpaid and enforcement proceedings are initiated, the court may impose restrictions on leaving the country – both on the borrower and on the guarantor.

Such measures are applied under the Law on Enforcement and relevant judicial rulings, meaning that guarantors face the same legal obligations as borrowers when it comes to unpaid debts.

In short, if a borrower defaults, both borrower and guarantor can be held equally accountable before the law – and both risk travel restrictions, but only if ordered by a court.
